Install a pergola to give your house some character. This garden fixture will add both romance and tranquility to the aesthetics. A pergola can be installed in as little as one weekend when you enlist the help of your friends.

Many people use CFL bulbs, but few know how to deal with them when they break. Bulbs contain mercury, which is poisonous to living beings. Therefore, when one breaks, you should immediately clear out any person or pet so that the room can air out. Then clean up the glass fragments, using duct tape to carefully pick up the smallest pieces. Dispose of the shattered bulb in a double bag, and thoroughly vacuum the entire area, emptying the canister or bag immediately after.

As you plan on making home improvement projects, try to find out how to do certain things by yourself. The pros charge as much as $50 per hour, so tackling those projects on your own can save tons of money. Plus, you will have the satisfaction of knowing you did it yourself.

If you sign without realizing what the contract contains, you can lose a lot of time and money. Whether you trust him or not, read the details.

Clean with an old toothbrush you no longer use. Whether you?re cleaning the grout in your bath tub area or scrubbing engine parts, you will find that old toothbrushes do an outstanding job. What?s more is that they are free! Why get a new brush when you still have something with a lot of life in it! Save the money for later.

To save money, refinish dreary cabinets in lieu of replacing them. Repaint the cabinet base and replace the doors and fixtures to get an updated new look. It is a more affordable way to improve the look of the kitchen.

In rooms that are most used, installing ceiling fans will help circulate your home?s air. You will not need to turn your air conditioner up as high and you will get warm air moving in the winter. Fans typically can be switched so that they either draw or push air as needed.

News Corp Int'l news chief to step down

NEW YORK (AP) ? The head of media conglomerate News Corp.'s U.K. newspaper operations is stepping down.

Tom Mockridge, who was CEO of News International since July 2011, will leave the company at year-end to pursue outside opportunities, the company said in a statement Sunday. Mockridge joined the company in 1991.

News Corp. Chairman and CEO Rupert Murdoch says that Mockridge's "decision to step down is absolutely and entirely his own."

The conglomerate announced plans this summer to split into two public companies, one for its newspaper and book publishing business and the other for its fast-growing movie and TV operations. The Wall Street Journal said Saturday that its current managing editor Robert Thomson is being named CEO of the new, unnamed publishing company.

Murdoch will be chairman of both companies.

Researchers find evidence for water ice deposits and organic material on Mercury

Friday, November 30, 2012

Planetary scientists have identified water ice and unusually dark deposits within permanently shadowed areas at Mercury's north pole.

Using data collected by NASA's MESSENGER spacecraft, a team from UCLA crafted the first accurate thermal model of the solar system's innermost planet, successfully pinpointing the extremely cold regions where ice has been found on or below the surface.

The researchers say the newly discovered black deposits are a thin crust of residual organic material brought to the planet over the past several million years through impacts by water-rich asteroids and comets.

Understanding how water ice has been preserved on Mercury and where it came from may help scientists determine the conditions necessary for sustaining life on other planets.

This research, one of three MESSENGER papers published online today in the journal Science (and scheduled for upcoming print publication), sheds light on the long-standing issue of ice on Mercury. Several independent lines of evidence now reveal that the sun-scorched planet has extensive water ice deposits at its poles.

In the early 1990s, scientists were surprised to find that areas near Mercury's poles were unusually bright when observed with radar from Earth, a potential indication that ice might be present.

UCLA's David Paige, the lead author of one of the new Science papers and a self-described "professional ice finder," has studied the poles of planetary bodies in the solar system, from Mercury to Pluto.

"Mercury is the innermost planet in the solar system, and, arguably, it's among the least explored," said Paige, a professor of Earth and space sciences. "The surface of Mercury exhibits the most extreme range of temperatures of any body we know of in the solar system."

Within a single polar crater on Mercury, there are spots that reach the oven-like temperature of 500 degrees Fahrenheit within sight of areas cold enough to freeze and preserve water ice for billions of years. These "natural freezers" exist within the shadowed areas of polar-crater rims, which never experience direct sunlight due to the low angle of the sun at such high latitudes, Paige said.

Paige's team was able to use the first detailed topographic map of Mercury's north polar region produced by MESSENGER to generate an accurate thermal model of the pole. Their calculations of the planet's sub-surface temperatures are a near-perfect match to Earth-based radar observations and surface-brightness measurements made by the Mercury Laser Altimeter (MLA) instrument onboard the orbiting spacecraft.

Where their temperature model predicts water ice should be stable on the surface, the MLA nearly always measures unusually bright patches, indicative of surface ice deposits. In places where it is too warm for surface ice but cold enough for ice to exist beneath the surface, the MLA sees unusually dark material.

"This stuff we find covering the ice is darker than the rest of Mercury, which is already a really dark planet. That's amazing," Paige said. "At the very least, it means there is something out of the ordinary going on inside these permanently shadowed areas where the ice has accumulated."

The mysterious dark substance likely arrived on Mercury as part of the comets and asteroids that periodically crash into the planet, bringing water ice and a diverse cocktail of organic material, Paige said. In the searing daytime heat of Mercury, the only place water and organics can survive is within permanently shadowed craters.

But only in the very coldest areas of the permanently shadowed regions can water ice exist on the surface. In the warmer shadowed areas, the top layers of ice begin to evaporate away into space, leaving behind a layer of hardy organic molecules that are stable at higher temperatures and which turn black over time when exposed at the surface. Once the dark layer is thick enough, it protects the ice underneath, allowing a sub-surface ice deposit to survive.

"There are areas on the surface where it is too hot for ice to exist, but radar data from Earth show something bright reflecting from these areas, so we're pretty sure that there's water ice buried underneath," said co-author Matthew Siegler, a researcher at the Jet Propulsion Laboratory and a UCLA alumnus. "You need some kind of insulating layer to keep that heat from getting down to the ice."

The presence of bright ice and dark organics on Mercury's surface presents a mystery for MESSENGER researchers. Large comets and asteroids periodically impact Mercury, covering a huge swath of the planet in a layer of dirt and dust and adding further craters to the airless planet's already scarred landscape. For the water ice and black organic layers to remain exposed on Mercury's ancient surface, the deposits must have formed recently in the planet's geological history, or they must be maintained by new water brought to Mercury by smaller, more frequent impacts.

"Billions of years ago, the Earth acquired a layer of water and other volatile material that formed atmospheres, oceans and even the first organic molecules that started life," Paige said. "Understanding the origin of that material is a very important problem and is essential to finding out about the potential habitability of planetary systems around other stars."

Ellen Harju, a graduate student in the UCLA Department of Earth and Space Sciences, is a co-author of the paper.

Paige's study was published alongside two other MESSENGER papers, with colleagues David Lawrence and Greg Neumann as the lead authors. All three research discoveries were showcased today in a press conference on NASA TV.

Launched in 2004, MESSENGER became the first spacecraft to orbit Mercury in March of 2011. Previously, the closest glimpse of the planet was provided by three fly-bys by the Mariner 10 spacecraft in 1974-75. The name MESSENGER, short for MErcury Surface, Space ENvironment, GEochemistry and Ranging, was chosen to evoke the Greco-Roman messenger deity Mercury, a god of trade, merchants and travel.

SCOV Law: Death Be Not Covered

In re Estate of Dunn v. Windham Northeast Supervisory Union, 2012 VT 93. Workers? compensation schemes have a simple structure: the State requires employers to carry workers? compensation insurance to reimburse employees for medical and economic losses resulting from work-related injuries?even if a third-party tortfeasor caused the injury. ?In the latter case, the insurer ends up paying the bill for someone else?s screw up.?

To be fair, Vermont?s workers? compensation program gives the insurer a right to recover its losses from whatever award the employee gets as compensation from the wrongdoer.? It also allows the insurer to go after the wrongdoer directly if the employee?doesn't?sue.? This is what is known in the business as subrogation: insurer gets to stand in the employee?s proverbial work shoes and sue the wrongdoer on the employee?s behalf.

Today?s case involves a work-related injury gone really, really bad: the employee, a member of the Windham Northeast Supervisory Union, had surgery for a work-related injury to her knee and died from ?complications.?? Following this tragedy, Employee?s family received death benefits from two sources: the school?s workers? compensation insurer, Vermont School Boards Insurance Trust; and Employee?s own life insurance policy, which went directly to her husband, its beneficiary.? Employer and the workers? compensation insurer (acting as Claimants against the Estate) went after the death benefits from the life insurance policy to offset what Insurer paid for the surgeon/hospital?s deadly mistake.? The Estate and Claimants met informally with the Department of Labor, then submitted cross motions for summary judgment to the Department of Labor Commissioner on the question of whether the governing statute, 21 V.S.A. 624(e), entitled Claimants to the reimbursement they wanted. The statutory provision that is the crux of this case allows the insurer to recover in two situations: 1) where the employee gets compensation from the tortfeasor; and 2) where the employee is also reimbursed by a private policy such as uninsured- or underinsured-motorist insurance, and would otherwise get reimbursed twice for the injury (?double recovery?).? The Commissioner read the statute to only allow recovery from a private policy?s proceeds where the proceeds were paid in connection with a third-party?s tort.? Claimants appealed. On appeal, the Department of Labor certified the question on appeal as whether Claimants were entitled to reimbursement from the life insurance policy for the benefits paid on account of her death.? This being a question of pure statutory interpretation, the SCOV owes no deference to any interpretations below; the Court reviews questions of law de novo.? Despite Claimants? creative arguments though, the SCOV agrees with the Commissioner and shoots down the Employer and Insurer?s attempt to dip into the life insurance pot. Claimants tried to label the life insurance policy death benefits payout as ?recovery of damages? for Employee?s death, which can be tapped under the statute.? But, the SCOV says, the word ?damages? is a term of art that is usually understood to mean ?pecuniary compensation, recompense, or satisfaction for an injury done or a wrong sustained.?? Life insurance policy proceeds provide a lump sum to the named beneficiary, or the deceased?s estate, as compensation for the loss of a loved one and post-mortem expenses, but there is no ?wrong? to trigger payment other than the insured?s death.? This interpretation is in keeping with the policy of fairness underlying the statute, the SCOV notes.? Where the employer isn?t directly responsible for the injury, such as when an employee is injured on the clock by an uninsured motorist, it?s only fair to let the workers? compensation insurer recover from whatever ?economic damages? the employee receives under their private uninsured motorist insurance policy. But wait! cry Claimants.??Doesn't?this exception for double recovery from an uninsured motorist policy mean that workers? compensation insurers can at least tap into the portion of life insurance benefits that are technically ?economic damages,? i.e., lost wages, medical expenses, etc.?? Sorry, the SCOV says, but in terms of life insurance ?death is not a ?loss,?? it?s merely the triggering event for a payout of a certain promised sum of money.? Unlike with workers? compensation, or even uninsured motorist coverage, an employee?s family?doesn't?have to prove the nature and scope of, or responsibility for, a particular injury to recover death benefits from a life insurance policy: all it has to do is provide a copy of the death certificate. The SCOV concludes that Claimants don?t get reimbursed from life insurance proceeds for having to pay for the surgeon/hospital?s epic failure.? Such is the life of a workers? compensation insurance carrier: win some, lose some, and hope that someone else will foot the bill.

Egyptians protest after draft constitution raced through

CAIRO (Reuters) - Thousands of Egyptians protested against President Mohamed Mursi on Friday after an Islamist-led assembly raced through approval of a new constitution in a bid to end a crisis over the Islamist leader's newly expanded powers.

"The people want to bring down the regime," they chanted in Tahrir Square, echoing the chants that rang out in the same place less than two years ago and brought down Hosni Mubarak.

Mursi said the decree halting court challenges to his decisions, which sparked eight days of protests and violence by Egyptians calling him a new dictator, was "for an exceptional stage" and aimed to speed up the democratic transition.

"It will end as soon as the people vote on a constitution," he told state television while the constituent assembly was still voting on the draft, which the Islamists say reflects Egypt's new freedoms. "There is no place for dictatorship."

The opposition cried foul. Liberals, leftists, Christians, more moderate Muslims and others had withdrawn from the assembly, saying their voices were not being heard.

Thousands packed Tahrir and hit the streets in Alexandria and cities on the Suez Canal, in the Nile Delta and south of Cairo, responding to opposition calls for a big turnout.

The disparate opposition which has struggled to compete with well-organized Islamists has been drawn together and reinvigorated by the crisis. Tens of thousands had also protested on Tuesday, showing the breadth of public anger.

But Islamists have a potent political machine and the United States has looked on warily at the rising power of a group they once kept at arm's length now ruling a nation that has a peace treaty with Israel and is at the heart of the Arab Spring.

Protesters said they would push for a 'no' vote in a referendum, which could happen as early as mid-December. If approved, it would immediately cancel the president's decree.

"We fundamentally reject the referendum and constituent assembly because the assembly does not represent all sections of society," said Sayed el-Erian, 43, a protester in Tahrir and member of a party set up by opposition figure Mohamed ElBaradei.

"Leave, leave," some chanted, another anti-Mubarak slogan.

In the Cairo mosque where Mursi said Friday prayers, some opponents chanted against him but backers quickly surrounded him shouting in support, journalists and a security source said.

Thousands of Mursi supporters also turned out in Alexandria.

EXHAUSTION

The plebiscite on the constitution is a gamble based on the Islamists' belief they can mobilize voters again after winning all the elections since Mubarak was overthrown in February 2011.

Despite the big numbers opposed to him, Mursi can count on backing from the disciplined Brotherhood and Islamist allies, as well as many Egyptians who are simply exhausted by the turmoil.

"He just wants us to move on and not waste time in conflicts," said 33-year-old Cairo shopowner Abdel Nasser Marie. "Give the man a chance and Egypt a break," he said.

But Mursi needs the cooperation of judges to oversee the vote, though many were angered by Mursi's decree that they said undermined the judiciary. Some judges have gone on strike.

The assembly concluded the vote after a 19-hour session, quicker than many expected, approving all 234 articles covering presidential powers, the status of Islam, the military's role and rights of citizens.

In one historic change, the president was limited to eight years in office after Mubarak served for 30 years. It introduced a degree of civilian oversight over the military - though not enough for critics.

An Egyptian official said Mursi was expected to approve the document on Saturday and then has 15 days to hold a referendum.

"This is a revolutionary constitution," said Hossam el-Gheriyani, head of the assembly in a live broadcast of the session, asking members to launch a cross-country campaign to "explain to our nation its constitution".

The vote was often interrupted by bickering between the mostly Islamist members and Gheriyani over the articles. Several articles were amended on the spot before they were voted on and the assembly worked till early morning to finish the job.

Critics argue it is an attempt to rush through a draft they say has been hijacked by the Muslim Brotherhood, which backed Mursi for president in a June election, and its Islamist allies.

Two people have been killed and hundreds injured in protests since the decree was announced on November 22, deepening the divide between the newly empowered Islamists and their critics.

PLACATING OPPONENTS

Setting the stage for more tension, the Muslim Brotherhood and its Islamist allies have called for pro-Mursi rallies on Saturday. But officials from the Brotherhood's party changed the venue and said they would avoid Tahrir Square.

Seeking to placate opponents, Mursi welcomed criticism but said there was no place for violence. "I am very happy that Egypt has real political opposition," he told state television.

He said Egypt needed to attract investors and tourists. The crisis threatens to derail a fragile economic recovery after two years of turmoil. Egypt is waiting for the International Monetary Fund to finalize a $4.8 billion loan to help it out.

An alliance of opposition groups pledged to keep up protests and said broader civil disobedience was possible to fight what it described as an attempt to "kidnap Egypt from its people".

Several independent newspapers said they would not publish on Tuesday in protest. One of the papers also said three private satellite channels would halt broadcasts on Wednesday.

The draft injects new Islamic references into Egypt's system of government but keeps in place an article defining "the principles of sharia" as the main source of legislation - the same phrase found in the previous constitution.

The president can declare war with parliament's approval, but only after consulting a national defense council with a heavy military and security membership. That was not in the old constitution, used when Egypt was ruled by ex-military men.

Activists highlighted other flaws such as worrying articles pertaining to the rights of women and freedom of speech.

A new parliamentary election cannot happen until the constitution is passed. Egypt has been without an elected legislature since a court order dissolved the Islamist-dominated lower house in June.
