Capitol Confidential ? The state's new campaign finance regs

The State Board of Elections was supposed to adopt regulations governing independent expenditures ? the uncoordinated advertising and mail ? by January. It finally, quietly, adopted rules two weeks before the election.

They won?t do much. As I reported Sunday, the regulations are less stringent than those required by federal and New York City officials. They won?t capture ?electioneering? communications ? any ad that clearly identifies a candidate that?s aired within 30 days of an election ? and take a very limited view of what kinds of ads count as direct advocacy.

?The rules that had existed before were very vague about what had to be disclosed ? but now, people can very explicitly see they can get away without filing (with the state board) if they are creative with their language,? Bill Mahoney, research coordinator for the New York Public Interest Research Group, told me. ?It will make it even easier for independent expenditure committees, Super PACs, to hide who?s paying for them, and because of that it will lead to language that is much more harsh than what we?ve heard?before.?
